...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents not sanctioned and releasing the Encashment of Earned Leave to the petitioner even though he was retired from service on 30.09.2025 and no charge memo and no criminal case against the petitioner is highly illegal, arbitrary, unjust, improper, contrary to A.P. Revised Pension Rules and contrary to orders of this Hon'ble Court and Violation of Article 14,16 and 21 of the Constitution of India and consequently direct the respondents to sanction and releasing the Encashment of Earned Leave to the petitioner with Interest of 12 percent per annum and to pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay the Encashment of Earned Leave to the petitioner forthwith due to retirement of age superannuation on 30.09.2025 and to pass Counsel for the Petitioner:

THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 11212 OF 2026
ORDER:-
The present Writ Petition is filed questioning the action of the Respondents in not sanction and release the encashment of Earned Leave to the Petitioner as illegal and arbitrary.
2. The Petitioner had retired from service on 30.09.2025 as Panchayat Secretary Grade-IV, Annavarapulanka, Kollipara Mandal, Guntur District, after rendering service for substantial time. After his retirement, the Petitioner was paid all retirement benefits, except encashment of Earned Leave.
3. Learned Standing Counsel for the Respondent/ Gram Panchayat passed on signed instructions of the Mandal Parishad Development Officer, Kollipara Mandal, dated 25.04.2026, wherein it is stated that on 10.10.2025, the amount for encashment of Earned Leave was submitted to the Sub- Treasury Officer, Duggirala, which was approved on 14.10.2025 and further forwarded to the Government for payment, but same is waiting for fund clearance.
4. Considering the submissions made by learned Standing Counsel for the Respondent/ Gram Panchayat and as the entitlement of the Earned Leave of the Petitioner is not disputed by the Respondents, this Writ Petition is
disposed of, directing the Respondents to release the Earned Leave amount to the Petitioner, within a period of two (02) months from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel, pending applications, if any, shall stand closed.
