ORAL ORDER (PER: THE HON'BLE MR. JUSTICE V.SRISHANANDA)
Heard Sri Mrityunjaya Yaragamblimath, learned counsel for petitioner and Sri Jagadish Patil, learned counsel for respondent. 2. Petitioner is the illegal occupant of the quarters bearing No.TRT 9/49. Respondent/company initiated eviction proceedings against the petitioner by filing an application under Section 452 of the Companies Act. 3. The said petition is being contested by the petitioner herein. Admittedly, the petitioner was inducted into the said premises on the ground that he was the employee of West Coast Paper Mills Limited. 4. In other words, the quarters was allotted to the petitioner based on his employment as a perk which was attached to his employment. Soon after his employment, he has to vacate and hand over the premises, but petitioner is hanging on to the premises illegally. 5. Petitioner has taken a contention that the premises on which building is constructed belongs to CMC constructed by

Housing Board and therefore, petitioner has no authority to evict him. 6. Same is opposed by respondent. At any rate, petitioner is not the owner and is illegal occupant of the premises. If the CMC is the owner, it is the matter that has to be thrashed out between the CMC and the respondent/Company. 7. Petitioner has no right to hang on to the said property under the pretext that the property belongs to CMC and CMC has to take action. 8. Admittedly, it is the respondent who inducted the petitioner to the premises and therefore, petitioner has to hand over the premises to the respondent after his retirement on account of superannuation and not set up the title in somebody else. 9.
Accordingly, there is no merit in the present petition and the application filed for permission before trial Court is rightly rejected by the learned trial Judge and requires no interference under the inherent powers of this Court under Section 482 Cr.P.C.
