P NAGENDRA REDDY 2 The Court made the following: ORDER: The Criminal Revision Case has been filed under Sections 397 & 401 of the Code of Criminal Procedure, 19731, challenging the docket order dated 18.01.2019 in C.F.R. No.106 of 2018 on the file of the learned Principal Junior Civil Judge, Kurnool. 2. Though on 25.04.2019 personal notice was directed to be served on Respondent Nos.1 to 4, no notice was served upon them. 3. There is no representation for the Petitioner. Hence, Mr.K.Mahadev, learned counsel, is appointed as learned legal aid counsel for Petitioner in this case. The Secretary, High Court Legal Services Committee, is directed to issue necessary proceedings in this regard. 4. Mr.K.Mahadev, the learned Legal Aid Counsel for the Petitioner, while reiterating the grounds of revision, urged that the order of the learned Trial Court is erroneous and liable to be set aside. 5. Per contra, Mr.A.Sai Rohith, the learned Assistant Public Prosecutor submits that the learned Trial Court had sufficiently dealt with the matter and, by assigning cogent and convincing reasons, dismissed the complaint. He further submits that no interference is warranted and urged dismissal of the Criminal Revision Case. 6. Heard the learned Legal Aid counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 1 ‘the Cr.P.C.,’ 3 7. The docket order dated 18.01.2019 in C.F.R. No.106 of 2018, whereby a private complaint filed by the Petitioner/Complainant was dismissed on the ground that no prima facie accusation was made out against Accused Nos.1 to 4, is under challenge in this Revision Case. 8. On perusal of the record, the sale deeds allegedly executed in favour of the complainant are registered sale deeds. The cancellation deed is also a registered document. The agreement of sale‑cum‑GPA is likewise registered. The Petitioner, an educated lady working as Assistant Director of Animal Husbandry, Ongole, cannot disclaim knowledge of these transactions. The learned Trial Court rightly pointed out that, being an educated person, she was not supposed to deny her knowledge of the execution of the registered cancellation deed and the registered agreement of sale‑cum‑GPA. 9. The learned Trial Court further pointed out that Accused Nos.1 to 4 were in no way connected with the registered deeds dated 06.02.2003, 25.02.2003, and 12.05.2009. The complainant had the remedy of filing a civil suit for recovery of amounts allegedly paid, but no steps were taken in that regard. The learned Trial Court rightly held that no prima facie case was made out against the Respondents for taking cognizance of offences punishable under Sections 420, 406, 465 and 471 read with Section 109 of the Indian Penal Code, 18602. There are no merits in this case. Hence, the Criminal Revision Case is liable to be dismissed. 2 ‘the I.P.C.,’ 4 9. In the result, the Criminal Revision Case is dismissed. No order as to costs.
