Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following reliefs:- “i) The Respondents may be directed to convert the Applicant from Non-Teaching cadre to teaching cadre as has been done in case of Programmers, Cartographer, and Coaches etc. along with all consequential benefits along with the pay protection benefit. ii) That the Respondents may be directed to grant the Applicant benefit of Time Scale/Career Advancement Scheme on and w.e.f. the day he has completed 04, 09 and 14 years service from the date of his initial appointment i.e. in the years 2001, 2006 and 2011 respectively with all consequential benefits along with interest @ 12%. iii) That in alternate the present Original Application may kindly be allowed and the Respondents may kindly be directed to frame the recruitment and promotion rules for the post of Instrumentation Engineer in Department of Bio-technology, HPU and the Respondents may be further directed to grant the benefit of Promotion and Other benefits incidental to his service on and w.e.f. the date he became eligible for the same, as has been done 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:12847 in case of other similarly situated incumbents working on the analogous posts in the Respondent University.” 3. When the case was taken up for consideration, learned Counsel for the petitioner submits that the present petition be disposed of by issuing a direction to the Authorities to consider the case of the petitioner in light of judgment dated 01.01.2026, passed by the Hon’ble Coordinate Bench of this Court in CWP No.10665 of 2023, titled Dr. Vijay Kumar Sharma Versus Himachal Pradesh University, alongwith connected matter. 4. Learned Counsel for the respondents submits that let the petitioner represent afresh in light of the judgment being relied upon and within reasonable time appropriate orders thereupon shall be passed. 5. As prayed for, this petition is disposed of with the direction that in the event of the petitioner filing a representation with regard to the issue raised in this petition to the competent Authority within a period of two weeks from today, let the same be decided in accordance with law, within a period of six weeks thereafter, in view of the averments made therein as well as judgments, if any, being relied upon by the petitioner, by passing a speaking order.
