J U D G M E N T (Judgment of the Court was made by S.M.Subramaniam, J.) The present writ appeal has been instituted challenging the
order dated 08.09.2023 passed in W.P.No.33405 of 2012. The writ petitioner is the appellant. 2.The order dated 25.10.2012 passed by the Commissioner, Salem City Municipal Corporation, Salem, stating that the seniority of the appellant would be reckoned from the date of her regular appointment to the post of Junior Engineer, i.e., 22.10.1999, was taken into
consideration. Based on the said date of regular appointment, seniority list was published by the Salem City Municipal Corporation. The writ Court has dismissed the writ petition on the ground that the appellant was promoted to the post of Assistant Executive Engineer and further the appellant filed another writ petition in W.P.No.12420 of 2023 challenging the rejection of similar request made by the appellant. https://www.mhc.tn.gov.in/judis
WA NO.1633 OF 2026 Page No.3 of 4 3.The learned counsel for the appellant would mainly contend that beyond the issue of seniority, the appellant has questioned the ratio of 3:1 to be followed for grant of promotion to the post of Assistant Executive Engineer, as per the Service Register. However, no such grievance has been set out either in the writ petition or in the present writ appeal. That apart, the order applying the prescribed ratio in terms of the relevant Rules is also not under challenge. In the absence of any such pleadings or challenge, the appellant cannot be permitted to raise a new ground relating to the applicability of 3:1 ratio, in the present appeal. If at all the appellant has any grievance, in this regard, it is for the appellant to work out her remedy in the manner known to law. 4.With these observations, the writ appeal stands dismissed. However, there shall be no order as to costs.
