State of Uttarakhand …Respondent Hon ’ble Ash ish Nait h an i, J. Ms. Rajni Rangwal, learned counsel for the Applicant. 2. Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Ankit @ Chotu, who has been accused in FIR No.0237 of 2025, dated 24.06.2025, under Section 190, 191 (2), 191 (3), 109, 115, 351 (2) and 352 of the BNS, 2023, at Police Station Ramnagar, District Nainital. 4. Learned counsel representing the Applicant submits for the consideration of the bail that co-accused has been granted bail, and thus, it is a case of parity. 5. As per the prosecution story that on 13/06/2025 at around 10.30 pm, the Complainant’s son Sikandar was on his Transport, when suddenly Chandan Sagar S/o Chhatrapal Sagar, and Chotu along with about 15-20 unknown persons came riding on motorcycles and tempos with sticks and sharp edged weapons in their hands and forcibly entered inside and started abusing and beating Sikandar. The said people pulled Sikandar out from inside and with the intention of killing him, hit him on the head with a sharp weapon. Thinking Sikandar dead, the said people went away from there. As he was leaving, he threatened that if anyone complained about this, they would meet the same fate as Sikandar. The Doctor treating Sikandar stated that Sikandar had suffered a minor injury to a delicate part of his head, and if the injury had been worse, he could have died. The injuries he sustained were fatal. 6. Firstly the Applicant who has been named as Chotu which is his @ name, and specifically not named as Ankit and moreover the parentage (S/o has also not been mentioned). 7. The bail application of the Applicant has been vehemently opposed by the learned State Counsel. 8. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 9. Accordingly, bail application is allowed. It is directed that the Applicant - Ankit @ Chotu, who has been accused in FIR No.0237 of 2025, dated 24.06.2025, under Section 190, 191 (2), 191 (3), 109, 115, 351 (2) and 352 of the BNS, 2023, at Police Station Ramnagar, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
