Himani Kundu is an elected candidate for the Block Pramukh Election of Block Hawalbagh, District Almora and her election was challenged in an election petition filed by the respondent no.1 which is registered as an Election Petition No.06 of 2025. 5. It is submitted that initially the election petition was filed in the court of District Judge, Almora, but, subsequently it was transferred to Ranikhet. Since, the petitioner as well as the election petitioner belongs to Almora, consequently, the returned candidate herein preferred a transfer application under Section 24 of CPC for transferring the proceedings of Election Petition No.06 of 2025 from the court of Ranikhet to Almora. 6. Mr. Yogesh Kumar Pacholia, learned counsel put his appearance for the respondent no.1. 7. Mr. Sanjay Bhatt, learned counsel put his appearance for the respondent nos.2 and 3. 8. Learned counsel for the respondents submits that they have no serious objection on the transfer of the election petition. 9. Mr. Yogesh Kumar Pacholia, learned counsel appearing for the election petitioner submits that the election petitioner also belongs to Almora, therefore, if the election petition is transferred to Almora, it will be more convenient to the election petitioner. 10. In such view of the matter, since learned counsel for the parties are agreeable for transfer of the election petition from Ranikhet to Almora, the instant writ petition is disposed of finally by setting aside the order passed by the learned District Judge, Almora dated 12.11.2025. Consequently, Election Petition No.6 of 2025 is hereby transferred from Ranikhet to Almora, and the concerned court is directed to remit the entire record of Election Petition No.6 of 2025 to the District Judge, Almora, so that the District Judge may either proceed with the election petition himself or nominate particular court for expediting the same.
