Heard Mr. A K Azad, the learned counsel appearing for the petitioner. Also heard Mr. Bhaskar Sarma, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail in connection with Tarabari Case No.09/2026 (GR Case No. 181/2026). 3. On the day of occurrence, police detained a truck containing 17 numbers of

Police registered the case under Section 13 (1) of the Assam Cattle Preservation Act, 2021 read with Section 11 (1) (a) (d) (e) (h) of the Prevention of Cruelty to Animals Act, 1960. 4. Mr. Azad has submitted that the petitioner has purchased the goods at Baghbar Bazar within the district of Barpeta and he was detained within the district of Barpeta itself. 5. According to Azad, the case of the petitioner comes within the Exception (1) Sub-Section (6) of Section 7 of the Assam Cattle Preservation Act, 2021. 6. Mr. Azad has further submitted that the petitioner had purchased the goods within the district of Barpeta and he was detained within the district of Barpeta and therefore, no permit is required to purchase the goods within the district of Barpeta. 7. I have considered the submissions made by the learned counsel of both sides. I have also gone through the materials available in the record. 8. This Court is of the opinion that under the given circumstances, the petitioner does not deserve to be detained in custody. 9. Accordingly, the Anticipatory Bail Application of the petitioner is allowed. 10. It is hereby directed that in the event of arrest in connection with Tarabari Case No.09/2026, the petitioner Aminul Miah shall be released on bail of Rs.25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the arresting authority. He shall co-operate with the Investigating Officer as and when called for.
