Page No.# 2/3 BEFORE HONOURABLE MRS. JUSTICE SUSMITA PHUKAN KHAUND ORDER 05.05.2026 Heard Mr. M.Z. Shah, learned counsel for the petitioner and learned counsel, Mr. T.A. Laskar, is present for the respondent no.2. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State.
2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the petitioner namely, Sultan Hussain, who is stated to have been in custody since 04.03.2026, has prayed for bail in connection with Lanka P.S. Case No. 32/2026 under Sections 140/61(2)/351 of BNS, 2023, R/W Section 8 of POCSO Act.
3. It is submitted on behalf of the petitioner that the petitioner is behind bars for more than 60 days and his right to personal liberty has been curtailed as charge-sheet has not yet been submitted.
4. The learned Additional Public Prosecutor has submitted that charge- sheet has not yet been submitted.
5. The petitioner is booked under Sections 140/61(2)/351 of BNS, 2023, R/W Section 8 of POCSO Act.
6. After considering the submissions at the Bar, the above-named petitioner is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of like amount subject to the satisfaction of the learned Special Judge, POCSO, Srimanta S/Nagar, Hojai, Assam with following conditions:
Page No.# 3/3 (i) That the petitioner shall not tamper with evidence; (ii) That the petitioner shall cooperate with the trial.
7. On breach of any of the bail conditions, bail order shall stand cancelled.
8. Accordingly, the bail application stands disposed of. JUDGE Comparing Assistant
