PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1 to 7 on bail in Crime No.46 of 2026 of II Town Police Station, Tirumala, registered against the Petitioners/Accused Nos.1 to 7 herein for the offences punishable under Section 109(1), 118(1), 191(2), 191(2), 191(3), 351(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Mr. D. Purnachandra Reddy, learned counsel for the Petitioners, submits that the Petitioners are innocent of the alleged offences and have been falsely implicated by the police. The Petitioners have not committed any offence. They are a law-abiding citizens. The Petitioners undertakes to abide by any conditions that this Court may deem fit to impose while granting bail. Hence, it is urged to allow the petition. 3. Per contra, Mr. A. Sai Rohit, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioners, submitting the investigation is still in progress and several material witnesses remain to be examined. It is contended that if the Petitioners are released on bail at this stage, there is a strong likelihood of his absconding, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged that the petition be dismissed. 4. Heard learned counsel for the Petitioners and learned Assistant Public Prosecutor. Perused the record. 5. On a perusal of the material available on record, it is evident that the de-facto complainant sustained injuries which are simple in nature. The petitioners were arrested on 07.06.2026 and have been in judicial custody for the past 38 days. It is further noticed that there is a case and a counter-case arising out of the same incident between the parties. The present case in Crime No.46 of 2026 was registered on 06.06.2026 at the instance of the de-facto complainant. One of the petitioners also lodged a complaint against the de-facto complainant, which was registered as Crime No.45 of 2026. It is also brought to the notice of this Court that the petitioners have no similar adverse criminal antecedents. 6. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioners/Accused Nos.1 to 7, this Court is inclined to enlarge the Petitioners/Accused Nos.1 to 7 on bail with some stringent conditions. 7. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioners/Accused Nos.1 to 7 shall be enlarged on bail subject to his executing a bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for the like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Tirupati. ii. The Petitioners/Accused Nos.1 to 7 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. iii. The Petitioners/Accused Nos.1 to 7 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioners/Accused Nos.1 to 7 shall not commit or indulge in commission of any offence in future. v. The Petitioners/Accused Nos.1 to 7 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the Investigating Officer as and when required. vi. The Petitioners/Accused Nos.1 to 7 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. vii. The Petitioners/Accused Nos.1 to 7 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer. _________________________ DR. Y.
