The petitioner is an accused in connection with Rajmahal P.S. Case No. 280 of 2021 corresponding to S. T. No. 43 of 2025. The prayer for bail of the petitioner was earlier dismissed as withdrawn in B. A. No. 1609 of 2025. It has been submitted by the learned counsel for the petitioner that as per the allegation, the petitioner as well as one Mukesh Mandal is said to have fired at the informant and he had sustained a fire arm injury at his leg. He further submits that the petitioner is in custody since 22.11.2024 and out of 10 charge-sheeted witnesses only 4 witnesses have been examined so far by the prosecution. Learned A.P.P. for the State has opposed the prayer for bail. There appears to be some ambiguity with respect to the person who had shot at the informant. Moreover, considering the period of custody and the fact that the 6 witnesses are still left to be examined, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge III, Rajmahal in connection with Rajmahal P.S. Case No. 280 of 2021 corresponding to S. T. No. 43 of 2025, subject to the condition that he shall physically present on each and every date before the learned trial court till the conclusion of trial, unless prevented by sufficient cause.
