The above three first bail applications have been filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime Nos.520/2021, 524/2021, 450/2021 respectively registered at Police Station Kota District Bilaspur C.G. for offence punishable under Sections 457, 380, 413, 34 of IPC. 2. The case of the prosecution is that the applicant and other co- accused on different dates have stolen, 60 quintals of rice, 1 bag (50kg) of sugar and 5 bags (2.5 quintals) of gram (chana) from a Fair Price Shop operated by one Dashmath Bai; 45 bags (22.5 quintals) of rice from a Fair Price Shop operated by one Bheem Kumar Suryavanshi; 166 bags of rice each 50ks from a Fair Price Shop operated by one Laxminarayan Yadav. 3 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He submits that co-accused namely Vijay Patre and Daulat Patre have already been enlarged on regular bail by Coordinate Bench of this Court vide order dated 20.04.2022 passed in MCRC No.1701 of 2022 and case of the present applicant is similar to that of theirs. Considering the backdrop, He prays for releasing the applicant on regular bail. 4. On the other hand, learned counsel for the State opposes the bail applications, however, they would not dispute the fact that case of present applicant is similar to that of co-accused namely Vijay Patre and Daulat Patre who have already been enlarged on regular bail. 5. Having heard learned counsel for the parties, considering the facts and circumstances of the case, particularly considering that other co-accused namely Vijay Patre and Daulat Patre have already been enlarged on regular bail by Coordinate Bench and the applicant is in jail since 17.12.2025 and case of present applicant is similar to that of theirs, I am of the opinion that present is a fit case to release the applicant on regular bail. 6. Accordingly, all the applications are allowed and it is directed that on applicant’s furnishing a personal bond for a sum of Rs.50,000/- with two sureties in the like amount to the satisfaction of the trial Court, he shall be released on bail on 4 the following conditions: a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the Applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) he shall not involve himself in any offence of similar nature in future. (f) he shall furnish all the details of movable and immovable property, bank accounts and his family members i.e. wife and children and shall not alienate the immovable property without the written permission of the concerned Court below.
