KAMAL ORAL ORDER The petitioner/accused No.2 is before this Court seeking for grant of anticipatory bail in Crime No.97/2026 registered by Hennur Police Station for the offence under Sections 109, 115(2), 118(1), 351(2), 352 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023. Brief facts of the case: 2. The case of the prosecution is that on 24.02.2026 at about 01.30 p.m., victim and his friends have gathered to celebrate the birthday of accused No.1, - 3 - HC-KAR NC: 2026:KHC:24542 CRL.P No. 5261 of 2026 in which, a quarrel broke out, resulting in assault causing bleeding injuries and consequent registration of the case. 3. Learned counsel for the petitioner submits that neither in the complaint nor in the FIR, name of the accused is shown. It is only upon the alleged voluntary statement of accused No.1, his name has surfaced. No overt act of any nature whatsoever has been attributed to the appellant. Hence, he seeks to release on bail. 4. Learned Additional State Public Prosecutor submits that since the overt act has been attributed to the accused persons with whom the petitioner alleged to have been, he also stands in the same footing. Hence, she seeks for rejection of the bail. 5. Heard and perused the records. 6. Perused the complaint and the FIR which would indicate the overt act having been attributed only to accused No.1/Kiran and his friends. There is no name or - 4 - HC-KAR NC: 2026:KHC:24542 CRL.P No. 5261 of 2026 any act attributed to the petitioner herein. His name is stated to have surfaced after recording the voluntary statement of accused No.1. In that view of the matter, this Court deems it appropriate to grant bail as sought for. 7. Accordingly, the following: ORDER (i) The petition is allowed. (ii) The respondent - Police are directed to release the petitioner in the event of his arrest in Crime No.97/2026 registered by Hennur Police Station for the offence under Sections 109, 115(2), 118(1), 351(2), 352 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the investigating officer. - 5 - HC-KAR NC: 2026:KHC:24542 CRL.P No. 5261 of 2026 2. Petitioner shall obtain regular bail within 15 days from the date of receipt of certified copy of this order. 3. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 4. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 5.
