IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 1520 of 2026 Dipu Behera …. Petitioner Mr. K. Pradhan, Advocate -Versus- State of Odisha …. Opposite Party Ms. B. K. Sahu, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 17.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case. No.374 of 2018 pending in the file of learned J.M.F.C., Chilika arising out of Tangi P.S. Case No.296 of 2018 on the grounds stated. 3. Perused the FIR as at Annexure-1. The petitioner had earlier approached this Court vide ABLAPL No.15182 of 2018 seeking pre-arrest bail. Learned counsel for the petitioner submits that in the meantime, the chargesheet was filed in 2020. The alleged occurrence is of the year 2018 and the details of the same are described in the FIR. This Court considering the nature of allegation is not inclined to reconsider the plea of pre-arrest bail as it appears to have been rejected earlier, however, is of the view that he should be directed to surrender before the learned court below seeking regular bail. 4. Accordingly, it is ordered. 5. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioner surrenders within a period of fifteen days from today before the learned J.M.F.C., Chilika in connection with G.R. Case No.374 of 2018 corresponding to Tangi P.S. Case No.296 of 2018 and moves an application for regular bail, it shall be duly considered in the first hour and in case of rejection, he shall approach the learned Sessions Court during the second hour for orders on the same day itself. 6.
