KAMAL ORAL ORDER Petitioner-accused No.1 is before this Court apprehending his imminent arrest in Crime No.12/2026 for the offence punishable under Section 306 of BNS, 2023 registered by Chintamani Town Police Station. 2. FIR indicate that petitioner was working as a Manager in Sara Mobiles. That during audit it was found 28 units of mobile phones and Rs.4,00,000/- were missing. The petitioner having learnt about the complaint has stopped attending his duty. Accordingly the complaint. 3. Learned counsel for petitioner submits that petitioner has been working in the shop for over four months. That the complaint itself indicate it is only during audit they found - 3 - HC-KAR NC: 2026:KHC:24494 CRL.P No. 6608 of 2026 missing 28 hand sets and Rs.4,00,000/- which could not have been attributed to the petitioner who worked only for a period of four months. Hence, seeks for allowing of the petition. 4. Learned Addl. SPP opposes the petition. 5. Heard and perused the records. 6. The allegation is of missing 28 units of hand sets and Rs.4,00,000/-. It is not clear as to which period the said mobile units and the amount found to be missing. It is also not clear as to for which period the audit was conducted. Even if the allegations are found to be prima facie true, since number of hand set units and amount is ascertained, recovery of the same would be only the aspect required to be undertaken by the investigation. Accordingly, following: ORDER Petition is allowed. Petitioner is directed to be enlarged on bail in the event of his arrest in Crime No.12/2026 registered by Chintamani Town Police Station, for the offences - 4 - HC-KAR NC: 2026:KHC:24494 CRL.P No. 6608 of 2026 punishable under Section 306 of BNS, 2023, subject to following conditions: 1. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/-(One lakh only) with two local sureties for the likesum to the satisfaction of the trial Court. 2. Petitioner shall appear before the Investigation Officer within 10 days from the date of receipt of certified copy of this order and shall appear daily for next fifteen days extending full co-operation in the investigation of the matter. 3. Petitioner shall appear before the trial Court and obtain regular bail within 15 days from the date of receipt of certified copy of this order 4. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 5. Petitioner shall not tamper with the prosecution witnesses. Sd/- (M.G.S.
