Government Pleader for Revenue The Court made the following: 3 BSB,J W.P.No.18305 of 2026 The Court made the following Order: This writ petition is filed under Article 226 of the Constitution of India to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents No. 2 to 7 in interfering with the peaceful possession and enjoyment of land to an extent of Ac.1.42 cents covered by Sy. No. 136/4B of Pernamitta village, Santhanuthalapadu mandal belonging to the petitioner by way of field inspection at the instance of the respondent No.8 as illegal, arbitrary and without jurisdiction and violation of Article 14, 21 and 300-A of the Constitution of India and violative the orders passed by this Court in W.P. No.17612 of 2025 dt.07.01.2026 while the conversion proceedings dt. 03.01.2023 are subsisting and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner’s subject land in the name of field inspection and enquiry and pass such other order, which this Court deems fit in the interest of justice. 02. The case of the petitioner is, briefly, as follows: The petitioner is a resident of Pernamitta village and has been doing agriculture in the ancestral land inherited from his deceased father. The petitioner sold an extent of Ac.2.00 out of an extent of Ac.4.9 ½ cents of bit, part of Ac.14.40 cents in Sy. No. 136 to Uppalapati Venkata Hari Prasad Raju, the respondent No.8 under a registered sale deed dt.25.09.1993 retaining the remaining extent of Ac. 2.9 ½ cents. The respondent No.8 converted the land of Ac.2.00 cents into plots and unauthorizedly sold them to the third parties. One Smt. Kunuru Seshamma purchased an unauthorised plot No. 66 from him and gave a complaint to the S.H.O., Taluk Police Station, Ongole town, Ongole, the respondent No.7, under Cr.No.15/2020 that the petitioner had removed the boundary stones and cultivated tobacco 4 BSB,J W.P.No.18305 of 2026 crop. The S.H.O. filed a charge sheet. During the investigation, it came to be known that the respondent No.8 did not take Grama Panchayat’s approval. But, C.C.No.2249 of 2022, in which the respondent No.8 is accused, was compromised before the Lok Adalat on 12.11.2021. After 6 years, he is trying to occupy the petitioner’s part of patta land of Ac. 2.00 out of total extent of bit Ac.4.9 ½ cent in Sy. No. 136 out of which the petitioner obtained conversion proceedings to an extent of Ac.1.42 cents in Sy. No. 136/4B. Later, the petitioner sold the part of converted property. Taking advantage of the vacant part of the converted land, the respondent No.8 is trying to encroach the land. The petitioner filed a suit in O.S. No. 204 of 2026 to restrain the respondent No.8 from interfering with the petitioner’s part of converted land. Even then, he is trying to occupy the land illegally and high handedly. The petitioner was constrained to file W.P. No.15126 of 2026 in which this Court directed the respondents Nos.3 and 4 not to call the petitioner to the police station, while issuing notice for filing counter vide order dated 04.06.2026. The order is subsisting till date. The District Collector, Prakasam district allowed the Tahsildar and the R.D.O., Prakasam district, Ongole to conduct field level inspection. The conversion proceeding dt.03.01.2026 is subsisting. The matter is pending before the Joint Collector, Ongole for adjudication. If the respondents Nos. 2 to 7 are not restrained from interfering with the petitioner’s peaceful possession of land of Ac.1.42 cents covered by Sy. No. 136/4B of Pernamitta village, S.N.Padu mandal, including the action of field inspection, the petitioner would suffer irreparable loss and injury. Hence, this writ petition was filed. 03. The learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the Tahsildar vide Rc. No. DT / 149 / 2026, dated 07.07.2026 which reads as follows: 5 BSB,J W.P.No.18305 of 2026 “One Sri Ravuri Linga Reddy S/o Late Gurava Reddy has filed a Writ Petition before the Hon'ble High Court pleasing to direct the respondents not interfere in the peaceful possession and enjoyment of the petitioner's land an extent of Ac 1.42 cents covered by Sy.No.136/4B of Pernamitta (V), S. N. Padu (M) in the name of field inspection and enquiry pending writ petition in this Hon'ble Court and pass such other or further as this Hon'ble court may deem fit and proper in the circumstances of the case. 3. It is submitted that this respondent No. 5 has not interfered with respect to the subject land. Furthermore, if any action or intervention is required in future regarding the subject property, this respondent will strictly follow the due process of law. 4. It is further submitted that, the petitioner's allegations are based on mere apprehension and lack of merit. Consequently, the writ petition is devoid of merits and liable to be dismissed at the admission stage itself, in the interest of justice and to protect the interests of the Government.” 04. The learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue requested to dispose of the writ petition recording the written instructions. 05. Accordingly, the writ petition is disposed of recording the written instructions as part of the order. It is also made clear that the respondents shall take action by following due process of law in case, any action is required. 6 BSB,J W.P.No.18305 of 2026 There shall be no order as to costs.
