The instant bail applications have been filed by the petitioners under Section 483 BNSS who have been arrested in connection with the FIR No.0008/2026 dated 16.01.2026 registered at the Police Station Sunel, District Jhalawar, for the offences under Sections 8/15 and 29 of NDPS Act. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the FIR wherein it has been alleged that the contraband in question, i.e., 10.472 kg of poppy husk, was recovered from the conscious possession of the petitioners. He further submits that the alleged contraband is below the commercial quantity. Learned counsel submits that though the petitioners have one criminal antecedent of similar nature, they have been implicated in the present case arising out of FIR No.002/2026 dated 17.01.2026 registered at Police Station Pagaria, District Jhalawar for the offences under Sections 8/15, 8/25 and 8/29 of the NDPS Act merely on the basis of statements of co-accused, as petitioner Dilip Singh has been implicated on the statement of one Shripal Singh and petitioner Shripal Singh has been implicated on the statement of Dilip Singh, and thus he urges that the petitioners deserve to be released on bail. 3. Per contra, learned Public Prosecutor opposes the bail application, however, is not in a position to refute the fact that the contraband recovered is below commercial quantity and petitioner Dilip Singh has been implicated on the statement of one Shripal Singh and petitioner Shripal Singh has been implicated on the statement of Dilip Singh. 4. Having considered the submissions advanced at Bar by learned counsel for the parties and having regard to the entirety of facts and circumstances of the case as available on record; and looking to the fact that trial may take a long time to conclude and, without expressing any opinion on the merits/demerits of the case, this Court deems it fit to enlarge the petitioners on bail. 5. Consequently, the bail applications are allowed. It is ordered that the accused petitioners (1) Dilip Singh S/o Suresh and (2) Shripal Singh S/o Balu Singh, arrested in connection with [2026:RJ-JP:9982] (3 of 3) [CRLMB-2126/2026] FIR No.0008/2026 dated 16.01.2026 registered at the Police Station Sunel, District Jhalawar, for the offences under Sections 8/15 and 29 of NDPS Act, shall be released on bail; provided they furnish personal bond in the sum of Rs.50,000/- each and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court, with a stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
