ORDER : 1. The present writ petition has been instituted challenging the order of the Tamil Nadu Public Service Commission stating that the provisional supplemental selection of the petitioner to the post of Civil Judge in the Tamil Nadu State Judicial Service was cancelled based on the order of the Hon’ble Selection and Appointment Committee dated 23.05.2025 2. The petitioner participated in the process of selection for appointment to the post of Civil Judge in Tamil Nadu State Judicial Service. She scored 256.360 marks in the examination. Her name was initially included in the selection list. Subsequently, Selection Committee found that yet another candidate who secured more than the writ petitioner was not considered for inclusion in the selection list and thereby identified the clerical error in entering the mark awarded by the examiners. In view of the fact that another candidate secured more than the mark secured by the petitioner, his name was included in the selection list and the name of the writ petitioner was cancelled. 3. In this context, a counter affidavit filed by the Tamil Nadu Public Service Commission would reveal the following facts which would be sufficient to consider the present writ petition: 8. In response to the Commission’s letter, the Registrar (Recruitment), Madras High Court had sent a letter dated 23.05.2025, mentioning that the letter of the Commission dated 14.05.2025 was placed before the Selection and Appointment Committee of the Hon’ble Madras High Court and in the meeting of the Hon’ble Selection and Appointment Committee held on 15.05.2025 and the said matter had resolved as follows: “A perusal of the said letter reveals that the marks scored by one Mr.P.Abinesh Karthik (Registration No.2601004111) have been wrongly entered by the examiner as 41 instead of 43 in Law Paper I and there appears to be a totalling error. If the marks scored by the said candidate in the written examination is taken at 43, his total scone would be 257.00 as opposed to 255.00 which is the present erroneous recording. The said candidate belongs to BC (OBCM) Category. One Ms.S.Cathrene Jeba Sakuntala, (Registration No.1001005010) is the last candidate appointed under BC(OBCM) Category. Her total marks is 256.50. The penultimate candidate appointed under BC(OBCM) Category is Mr.J.Rajkumar, (Registration No.0201002195). His total marks is 257.68. Therefore, Mr.P.Abinesh Karthik (Registration No.2601004111) comes in between Mr.J.Rajkumar, (Registration No.0201002195) and Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010) in the BC (OBCM) Category. One Ms.S.Cathrene Jeba Sakuntala, (Registration No.1001005010) is the last candidate appointed under BC(OBCM) Category. Her total marks is 256.50. The penultimate candidate appointed under BC(OBCM) Category is Mr.J.Rajkumar, (Registration No.0201002195). His total marks is 257.68. Therefore, Mr.P.Abinesh Karthik (Registration No.2601004111) comes in between Mr.J.Rajkumar, (Registration No.0201002195) and Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010) in the BC (OBCM) Category. Since Mr.P.Abinesh Karthik, (Registration No.2601004111) has got more marks than Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010), he will have to be appointed in the BC (OBCM) Category. He will be last candidate under that category. This will definitely have the effect of edging out Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010), as her marks are lower than that of Mr.P.Abinesh Karthik, (Registration No.2601004111). The consequence would be Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010), will move to the reserve list in the BC (OBCM) Category and she will be ranked one as the marks of the first Rank Holder in the reserve list in the BC (OBCM) category is 256.360. The Committee is informed by Mr.K.Baskara Pandian, under Secretary In-charge TNPSC and Mr.S.Arivuchelvam, Section Officer, TNPSC, that one candidate selected in the BC (OBCM) Category has not joined and the candidate who had obtained 256.360 has been informed that he/she has been provisionally selected through a Government Order is yet to be issued. Due to the increase in the marks of Mr.P.Abinesh Karthik, (Registration No.2601004111), the select list as well as reserve list under the BC(OBCM) category will have to be rearranged and as a consequence Ms.S.Cathrene Jeba Sakunthala, (Registration No.1001005010) who has scored 256.50 would secure appointment as a candidate from the reserve list. As directed, I am to request the Under Secretary to the TNPSC is required to place the above resolution of the Committee before the Commission for rearranging the select list as well as the reserve list under the bc (OBCM) category and pass appropriate orders as per the resolution of the Committee and the Tamil Nadu Public Service Commission to inform the Government to withhold issuance of the Government Order for appointment of the candidate, who has scored 256.360 and who is now the reserve list candidate No.1 in the BC (OBCM) category. The Tamil Nadu Public Service Commission will also carry out the necessary correction in the mark sheet/ make an errata/corrigendum as may be required of Mr.P.Abinesh Karthik, (Registration No.260100 4111)” 9. Based on the above resolution a revised rank list with selection category (already revised based on Court Order) relating to the post of Civil Judge had again been revised as per the merit order. 10. After Re-revising the rank List, the Rank of Thiru.P.Abinesh Karthik (Register No.2601004111) became 170 and he had reached thezone of selection under BC_G_PSTM_6/6_Sub category in main selection lit and the already selected candidte Tmt./Selvi.Cathrene Jeba Sakunthala (Reg.No.1001005010) was out of zone of selection under BC_G_PSTM_6/6_ Sub Category. 11. Hence, the main selection of Tmt./Selvi.Cathrene Jeba sakunthala (Reg.No.1001005010) (Sl.No.172 in the selection List) to the said was cancelled and she was kept in Reserve List under the following categories: GT_G_11/24 BC_W_PSTM_1/2 BC_W_1/9 BC_G_PSTM_1/6 BC_G_1/22 12. According to the said changes, the supplemental selection of Tmt/Selvi.S.T.Sunitha Rai (Reg No.2501002244) (SI.No.240A1 in the selection list) under BC (G) category was cancelled and the candidate Tmt/Selvi.Cathrene Jeba Sakunthala (Reg No.1001005010) was supplementally selected to the said post under BC(G) category from the reserve list. 4. Learned counsel for the petitioner would submit that the name of the writ petitioner is included in the reserve list. 5. In view of the above facts, the relief sought for in the present writ petition deserves no consideration on merits. Consequently, the information provided by the Tamil Nadu Public Service Commission, based on the resolution passed by the Hon'ble Selection and Appointment Committee of High Court of Madras is in accordance with the selection procedure as well as the rules. Thus, the Writ Petition stands dismissed. No costs.
