Let affidavit of service, as filed in Court, be kept on record. 2. The petitioner is an affiliated college to the Baba Saheb Ambedkar Education University. The petitioner, after having completed the process of admission, has found that an aggregate of 12 seats are lying vacant. 3. Since the process was advised to be completed by November 14, 2025, the same has been completed without filling up the afore-stated seats. 4. Mr. Chattopadhyay, learned Additional Government Pleader appearing for the State, submits on instructions that the State has no objection to consider and extend the time to enable the colleges 2 affiliated to the University, as afore-stated, to fill up the seats upon following due process of law. 5. In a similar matter in respect of the same University, an order has already been made on February 9, 2026, pursuant whereto I am informed by Mr. Baidya, learned Advocate appearing for the University, that the University has made an application with the Additional Chief Secretary to the Government of West Bengal, Department of Higher Education, on February 13, 2026. Such application, as and when allowed will be available for all students of the session in all affiliated colleges of the University including the petitioner herein. 6. The Additional Chief Secretary to the Government of West Bengal, Department of Higher Education, is directed to dispose of the application made by the University by March 31, 2026. 7. Since this application also pertains to the same University and session, it is made clear that it will not create any precedent for subsequent sessions and will not create any disruption for ongoing academic session of each of the colleges. 8. The students, so admitted, pursuant to the extension will be given additional and extra classes by the colleges in terms of the NCTE guidelines and fulfil all requisites to enable such students to sit for the semester examination. 3 9. With these directions, the writ petition is disposed of. 10. There shall, however, be no order as to costs. 11. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Reetobroto Kumar Mitra, J.)
