In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Sunil Kumar, who has been accused in connection with FIR No.111 of 2026, dated 10.04.2026 under Sections 8, 21 and 60 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station ITI, District Udham Singh Nagar. 4. As per the case of the prosecution that an FIR was lodged on 10.04.2026 with the facts that on 10.04.2026, SI Pankaj Kumar along with other police personnel was on routine checking, when at “Khokhra Mandir” two person on black scooty saw them and tried to escape, finding it suspicious, the police party caught them and when inquired for whereabouts the person riding the scooty told his name Sachin Kumar and the person sitting at back told his name Sunil Kumar and Sachin Kumar told that the Scooty belongs to him. On being Suspicious they were searched by the police and the major allegation in the FIR is that 67 grams of Smack was recovered from the pocket of the jeans of Sachin Kumar and 39 grams of Smack was recovered from the pocket of the Shirt of Sunil Kumar (Applicant). 5. Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present case. He further submits that the Applicant has no previous criminal history. It is also contended by the learned counsel for the Applicant that the Applicant has been languishing in jail since 10.04.2026. 6. The bail application of the Applicant has been vehemently opposed by the learned State Counsel. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Sunil Kumar, who has been accused in connection with FIR No.111 of 2026, dated 10.04.2026 under Sections 8, 21 and 60 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station ITI, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
