Kausik (Rejected) CRM (NDPS) 205 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 27/NCB/KOL/2023 dated 06.09.2023 under Section 8(c)/21(C)/25/28/29 of the NDPS Act, 1985. And In the matter of : Puran Sahu ……Petitioner. Mr. Anirban Chakraborty ……for the Petitioner. Mr. Gouranga Kumar Das Mr. Somnath Adhikary ……for the NCB/Union of India. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years and 4 months. He is innocent of the charges and out of 8 witnesses cited by the prosecution, partly one witness has been examined till date. As such, additionally it has been submitted since there is no possibility of the trial concluding in near future, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that more than 6,300 bottles of Phensedyl were recovered from a godown but one of the accused person had been absconding and as such whole of the process was delayed. Charges have been framed on 14.07.2025 and since 2 then all efforts have been made for progress of the trial of the case. Having considered that the trial of the case has commenced, learned Trial Court is directed to fix at least one schedule consisting of 3 dates in a month so that there is progress in the case. At this stage, the bail application being CRM(NDPS) 205 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
