JUSTICE S.R.KRISHNA KUMAR ORAL ORDER Learned counsel for the petitioner has filed a memo seeking leave of this Court to withdraw the petition, which reads as under: “MEMO FOR WITHDRAWAL The Petitioner most respectfully submits that the present Writ Petition has been filed raising, inter alia, apprehensions with regard to the biased nature, biased - 3 - HC-KAR NC: 2026:KHC:24451 WP No. 6774 of 2026 approach, arbitrariness, and procedural unfairness in the conduct of the ICC proceedings. However, upon instructions, the Petitioner seeks permission of this Hon'ble Court to withdraw the present Writ Petition, while seeking appropriate directions to the ICC to conduct the inquiry in a fair, reasonable, impartial, and transparent manner, strictly in accordance with the principles of natural justice, the provisions of the POSH Act, 2013, and the applicable rules. The Petitioner further submits that in the event there is any non-compliance with the principles of natural justice or any violation of the provisions of the POSH Act, 2013 or the rules framed thereunder, the Petitioner reserves liberty to approach the appropriate forum for seeking appropriate reliefs in accordance with law.
