Judgment : S.M.Subramaniam J. Uncondonable delay cannot be condoned by the Courts in routine manner. Appeals are to be filed within the period of limitation contemplated. Reasonable or meagre delay may be condoned by the Courts taking a lenient view. However, enormous delay cannot be condoned unless the reasons stated for delay are candid or convincing. 2. In the present case, learned counsel for the petitioner would submit that the delay of 810 days in filing the appeal occurred on account of administrative reasons. Even such administrative reasons are not substantiated. Thus, this Court is not inclined to condone the delay. 3. However, the appellant may conduct a departmental enquiry and find out the reasons for filing the appeal after prolonged time and if any officials have colluded for delaying the matter or if any officer has committed lapse / dereliction of duty in pursuing the appellate remedy in the manner known to law or has acted against public interest, suitable action including disciplinary proceedings are to be initiated against such officials who are responsible for not filing the appeal within the period of limitation as contemplated under law. 4. The Civil Miscellaneous Petition is dismissed and the Writ Appeal is rejected at SR stage.
