The petitioners state that the raiyati land of the petitioners is situated adjacent to a canal belonging to the Irrigation and Waterways Department of the Government of West Bengal. The petitioners allege that at the time of carrying out the renovation work of the canal, a portion of the raiyati property of the petitioners was damaged. The petitioners accordingly approached the Assistant Engineer, Irrigation Department, Purba Medinipur by a letter dated January 21, 2026, requesting the said authority to allow the petitioner to restore his property to its original condition. The learned advocate appearing for the petitioners submits that in spite of receipt of such representation, no steps have been taken by the respondent authority till date. 2 Mr. Mahata, learned Additional Government Pleader submits that the decision on such representation shall be communicated to the petitioners within the time limit as may be fixed by this Court. In the light of the submissions made by the learned advocates for the respective parties, WPA 4248 of 2026 stands disposed of by directing the Assistant Engineer, Irrigation Department, Purba Medinipur, being the respondent No.2, to consider the representation of the petitioners dated January 21, 2026 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioners and communicate the reasoned order to the petitioners as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated January 21, 2026. It will be open to the said respondent to obtain the views from any other authorities and also to afford an opportunity of hearing to any other person, who may be affected by such decision. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
