02/20.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Nawa Jaipur P.S. Case No.39 of 2025, registered for the offence under Sections 115(2), 117(2), 126(2), 303(2), 351(2), 352, 3(5) of the BNS and Section 3/4 of Prevention of Witch Practices Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Palamau at Daltonganj.

Learned counsel appearing for the petitioner submits that there are general and omnibus allegations of assault against all the accused persons. He further submits that the injury is simple in nature and that has come in the order of the learned Sessions Judge. He next submits that one of the co- accused has been granted anticipatory bail by the learned Sessions Judge. He also submits that the occurrence is dated 12.08.2025, whereas, the FIR has been lodged on 14.08.2025. He then submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 11 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there.

5. Looking into the contents of the FIR, it transpires that there are general and omnibus allegations of assault against all the accused persons. One of the co-accused has been granted anticipatory bail by the learned Sessions Judge. Further, the alleged occurrence is said to be of 12.08.2025, whereas, the FIR has been lodged on 14.08.2025. The petitioner has got no criminal antecedent, as disclosed in paragraph 11 of this application. In the attending
facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj in connection with Nawa Jaipur P.S. Case No.39 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
