1. Heard learned counsel for the applicant and learned counsel for the State.
2. The present application has been filed for grant of anticipatory bail in connection with Koderma P.S. Case No. 118 of 2022 (G.R. No. 614 of 2022), registered for the offence under Section 420 of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Koderma.
3. It has been submitted by the learned counsel for the petitioner that some of the co-accused have already been enlarged on regular bail and, as such, he seeks permission to withdraw the present anticipatory bail application with liberty to approach the trial court for grant of regular bail.
4. It is further submitted that the petitioner undertakes to surrender before the court concerned within three weeks from today.
5. In view of above submission, the present anticipatory bail application is hereby disposed of as withdrawn with aforesaid liberty.
6. It is clarified that if the petitioner surrenders and prays for regular bail before the concerned trial court, the same shall be considered on its own merits without being prejudiced to the order of this Court.
