HC-KAR NC: 2026:KHC-D:906 WP No. 104268 of 2025
ORAL ORDER
(PER: THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI)
The present writ petition is filed seeking the following prayer:
“a. Issue a writ of certiorari or any other appropriate writ, order or direction quashing the impugned public notice dated 25/06/2025 published on 26/06/2025 in samyukta karnataka newspaper by the respondents No.4 and 5 vide Annexure-D. b. Direct the respondent No.2 and 3 to take appropriate steps for the lawful constitution of a fresh managing committee of Anjuman-E-Islam, Alnavar strictly in accordance with the SOA and Wakf Rules. c. Pass such other order or relief as deemed fit in the interest of justice and equity.”.
2. It is the case of the writ petitioner that the respondent No.4 is a Wakf Institution. The Karnataka State Board of Wakf constituted the Managing Committee of 21 members for the management of the Wakf. The petitioners are the residents of Alnavar Taluk, Alnavar District, Dharwad and they are the members of the Wakf Institution and they have a right to participate in the election of the management of the Wakf Institution.

3. The term of the Managing Committee constituted by the order of the Board dated 06.04.2022 came to an end on
05.04.2025. The scheme of administration of Anjuman was approved by the respondent No.2 by its order dated 30.11.2024. It is stated that as per Rule 54 of the Karnataka Wakf Rules, 2017, the outgoing committee, prior to three months to the expiry of the term, shall complete the entire process of constitution of succeeding committee. If for any reasons, succeeding committee is not constituted or appointed, the management and supervision of such Wakf institution shall automatically vest with the District Wakf Officer. In terms of Rule 54(6) of the Wakf Rules, the outgoing committee shall cease to have any power or authority for the management of the Wakf Institution after expiry of its term. It is the grievance of the petitioner that respondent No.4 has issued a public notice calling for the general body meeting scheduled on 03.07.2025. The said notice is impugned in this writ petition.
4.
Learned counsel appearing for the petitioner submits that the term of the committee was extended till 04.07.2025. The Co-ordinate Bench of this Court has already granted an

interim order staying the operation and further proceedings arising out of the public notice dated 25.06.2025.
5.
Learned counsel appearing for the respondent No.2 submits that by the time the writ petition was filed, the period of the Board was already extended till 04.07.2025. It is submitted that, suppressing the said fact, the present writ petition is filed. The learned counsel appearing for the petitioner had denied the same.
6. Having heard the learned counsels on either side, perused the material on record.
7. The petitioner has sought for the quashing of the public notice dated 25.06.2025. An interim order is already granted. Whatever relief the petitioner is seeking is already worked out and nothing remains for adjudication in this petition. Hence, this Court is passing the following:
ORDER (i) Accordingly, the writ petition stands dismissed as infructuous.
