Petitioner has filed a memo along with paper publication, evidencing the notice taken through substituted service in respect of respondent. No representation on behalf of respondent. Accordingly, notice to respondent is held sufficient.
2. Heard Sri. Rajesh Gowda, learned counsel for petitioner.
3. In this petition, the petitioner has sought for appointment of an arbitrator in terms of Clause 17 of the Construction Agreement to Sell dated 26.11.2018 (Annexure- 'A').

4. Having taken note of the submission made by the
learned counsel for the petitioner, I am of the view that, Sri. M Ramesh , Retired District Judge is appointed to enter into the said reference of Arbitration and act as the Sole Arbitrator in the present case in the Arbitration and Conciliation Centre, Bengaluru, as per the Rules governing the said Arbitration Centre.
4. All claims and contentions of any of the parties are kept open to be decided by the Arbitral Tribunal.
5. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic & International), Khanija Bhavan, Bengaluru, for proceeding further in the matter.
6. Registry is directed to return all original documents produced by any of the parties after obtaining photostat copies of the same.
