UNNI KRISHNAN NAIR ORDER 04/05/2026 Heard Mr. S S S Rahman, learned counsel for the petitioners and Ms. D Mushahary, learned Standing counsel, Secondary Education Department, appearing for the respondents. 2. Ms. Mushahary, learned Standing counsel, Secondary Education Department has raised a preliminary objection that the petitioners in the present writ petition have resorted to misrepresentation with regard to the cases filed before this Court. In this connection, she has referred to paragraph-11, 12, 13 & 14 of the writ petition. 3. Mr. Rahman, learned counsel for the petitioners has very fairly submitted that the contentions raised by the learned counsel for the respondents is correct. However, he begs apology for the inadvertent projections made in the writ petition. 4. Considering the fact that the petitioners even with regard to the cases filed by them before this Court earlier have also misrepresented the facts, this Court is of the considered view that this is not a fit case, wherein, the extra Page No.# 6/6 ordinary jurisdiction of this Court under Article 226 of the Constitution, which is equitable in nature, would be called to be exercised. 5. At this stage, Mr. Rahman, learned counsel for the petitioners prays that he be permitted to withdraw the present writ petition without liberty to re-file the same by the same petitioners. 6.
