COURT’S OR JUDGE’S ORDERS
WPMS No. 1418 of 2026 Hon'ble Rakesh Thapliyal, J.
1. Mr. Anshu Kumar, learned counsel for the petitioners.
2. Mr. Ghanshyam Joshi, learned Addl. C.S.C. with Mr. Mahavir Kohli, learned Brief Holder for the State.
3. The counsel for the petitioner is not pressing relief ‘B’ and he is pressing only relief ‘A’.
4. Relief A relates to demarcation for which the petitioner already submitted an application to the SDM concerned on 20.02.2026, the copy of which is enclosed as Annexure 2. On this application the concerned Magistrate took cognizance and the revenue officials were also directed to inspect the spot but up till date no further steps have been taken to expedite the demarcation proceeding.
5. The relief, as sought, for expeditious disposal appears to be innocuous.
6. The State Counsel has no objection if relief ‘A’ is decided.
7. Since, by relief ‘A’, a innocuous prayer has been sought to expedite the demarcation proceeding, in such view of the matter the instant writ petition is disposed of finally with the direction to the S.D.M. Roorkee District Haridwar to proceed with the demarcation pursuant to the request made by the petitioner by letter dated 20.02.2026 in respect of land of khata no. 00537, khasra no. 167, 169/2, 174, 168 and khasra no. 175/1 and 175/2 measuring 2.817 hectare situated at Mauja Malakpur Latifpur Pargana and Tehsil Roorkee, District
Haridwar and expedite the same.
8. It is made clear that entire proceeding of demarcation be expedited within two months from the date of production of certified copy of the order.
