This bail application has been filed on behalf of Dara Singh who is in custody since 01.12.2025 in connection with Narayanpur P.S. Case No. 132 of 2025 for the offence registered under Sections 286, 292, 293, 274, 275, 338, 336(3), 340(2), 111(2)/(b) of the BNS, 2023 and Section 47(a) and 47(d) of the Excise Act, pending in the Court of learned Addl. Chief Judicial Magistrate, Jamatara, is pressed into motion.
The matter involves seizure of 3120 liters of spirit and 1890 litres of wine which were kept in gallons and bottles which were being transported by one DCM vehicle bearing Registration No. WB51C-5752 which was being driven by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner is a poor driver and was not involved in the illegal trade of liquor. As per the FIR, the liquor was being transported at the instance of one Raj Yadav who had taken the vehicle on hire from Subrata Biswas the owner of vehicle. Learned A.P.P. for the State opposed the prayer for bail.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
