Present Writ Appeal has been filed for setting aside judgment and order dated 25.11.2025, passed in W.P.No.2521 of 2017. 2. Learned counsel for appellants submits that a number of issues have been raised in the writ petition, including the question of enhancement of Assignment Fee, Ground Rent, etc., vide G.O. dated 09.10.2013. However, the writ petition was dismissed as infructuous on the premise that lease period came to an end on 17.07.2021 and was never extended in favour of the writ petitioners, i.e., the present appellants. It is contended that issues so raised 2 io_wa_798_2026 are relevant and ought to have been adjudicated, as their non-consideration would have wider implications. Reference is made to W.A. No.518 of 2026 and W.A. No.620 of 2026 to submit that in identical circumstances, appeals have been allowed and matter placed before learned Single Bench to decide the same afresh. 3. Learned counsel for respondents is unable to deny the same. 4. Keeping in view facts and circumstances as noted above, judgment and order dated 25.11.2025, is set aside and matter is remanded to learned Single Judge to decide afresh. There is no expression of opinion on merits of matter as such. 5. Registry is directed to list W.P.No.2521 of 2017 before appropriate Bench having Roster. Writ Appeal is allowed accordingly. No costs. Pending miscellaneous applications, if any, in this case, shall stand closed.
