This petition has been preferred by petitioner under Article 226 of the RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.03.11 16:46:00 +0530 2 Constitution of India seeking following reliefs:- “10.1 It is therefore prayed that, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to issued a writ/order/direction in nature of mandamus whereby to direct to the Respondent Authorities to provide adequate compensation with interest as well as other benefits such as employment which has been extended to the similar situated persons against acquisition of their land and further be pleased to direct the Respondent Authorities to comply with the directions within stipulated time. 10.3 That, any other relief/reliefs, which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the petitioner.” 3. Learned counsel for the petitioner submits that the petitioner purchased the land bearing Khasra No.604, area 0.040 hectares situated at Village Kathghodi, Tehsil Sonehat, District Surguja (now District Koriya), vide registered sale deed dated 11.02.1994 from one Annapurna Prasad Mishra. Subsequently, the aforesaid land was mutated in the name of the petitioner on 19.07.1996. He further submits that the said land has been acquired for the purposes of respondent -SECL; however, employment has not been provided to the petitioner or any member of his family. He next submits that despite repeated requests and representations made by the petitioner before the respondent authorities, his grievance has not been redressed. Lastly, he submits that the petitioner is ready to file a fresh representation before respondent No.2. Hence, learned counsel prays that, at this stage, the present petition may be disposed of with a direction to respondent No.2 to decide the representation filed by the 3 petitioner within a stipulated period. 4. On this, learned counsel appearing for the respondent Nos.1 to 5 submits that the subject land was acquired more than 30 years ago and, as per the petitioner himself, at the time of issuance of notification the subject land was not recorded in the name of the petitioner. Therefore, the petitioner is not entitled to claim employment or compensation. However, learned counsel submits that if the petitioner files a fresh representation, the same shall be considered and decided in accordance with law and the applicable policy/ rules. 5. Having considered the limited prayer made by learned counsel for petitioner and the submissions made by learned counsel for respondent Nos.1 to 5, the present petition is disposed of at this stage by granting liberty to the petitioner to file a fresh representation before respondent No.2, the General Manager, Baikunthpur Area, District Koriya (CG), within a period of 15 days from today along with a copy of this order. In the eventuality of filing such representation by the petitioner, the same shall be considered and decided by respondent No.2 within a further period of 60 days in accordance with law and the applicable policy/rules. 6. With aforesaid observation and direction, the writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
