ORAL ORDER (PER: THE HON'BLE MR.

The Sub-Urban Police Station, Hubballi, suo motu registered the case for the offences punishable under Section 25(1A), 25(1B), Section 30 of the Indian Arms Act, 1959 read with Section 34 IPC. 4. 5. In the second page of the complaint, it has been stated that in the presence of the punch witnesses, 15 live bullets and a licence bearing No.SPL 342/RON was seized. 6. Police after thorough investigation filed charge sheet on the ground that there is no proper licence and no proper entries have been made in the required register. 7. Both the accused persons have now been approached this Court with a prayer to quash the pending proceedings on the ground that all required entries have been made and to substantiate the same, original register with photocopy has been placed on record. 8. Learned High Court Government Pleader was furnished with the photocopy of the entries in the register. 9. This Court perused the same. Necessary entries have been carried out in the register and according to the first accused, same was also furnished to the police. 10. But investigation agency has ignored the same only with an intention to file a false charge sheet against the petitioner. - 5 -

11.
Taking note of the fact that the necessary entries have been carried out in the register and thereafter bullets have been purchased from the second accused shop who had licence to sell the bullets to the first accused firearm, this Court is of the considered opinion that the continuation of the pending criminal proceedings would result in abuse of process of law as no ingredients whatsoever made out which would attract the offence under Section 25(1A), 25(1B), Section 30 of the Indian Arms Act, 1959. 12. Hence, following order is passed. ORDER i. Petitions are allowed. ii. Pending proceedings in C.C.No.950/2020 against the petitioners stand quashed. Sd/- (V.SRISHANANDA) JUDGE
