No.10997 of 2026 ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent Police for the offence under Sections 118(2), 109 and 351(iii) of BNS, 2023 in Crime No.280 of 2026 on the file of the respondent police, seeks anticipatory bail. 2.The allegation against the petitioner is that the petitioner engaged the defacto complainant for doing some civil construction work. The defacto complainant demanded to raise the wages, due to which, there was a dispute between them. Enraged over the same, the petitioner attcked the defacto complainant using iron rod, which resulted in causing fractures in his leg. Hence, the case has been registered. 3.The learned counsel appearing for the petitioner submitted that that the petitioner is an innocent and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He is ready to cooperate with the investigation. He further submitted that there is no possibility of causing injury on the leg as stated by the defacto complainant. No.10997 of 2026 4.The learned counsel appearing for the intervener submitted that the defacto complainant sustained serious injuries and is undergoing treatment. It is further submitted that, if the petitioner is granted anticipatory bail, there is a likelihood of the petitioner threatening the witnesses. Hence, he prayed for dismissal of the petition. 5.The learned Counsel for State of TN (Crl. Side) appearing for the respondent Police reiterated the prosecution case and submitted that it is not a false accusation and the Accident Register copy has also been produced to substantiate the same. Hence, he opposed to grant anticipatory bail to the petitioner. 6.I have heard the submissions made by both sides and perused the Accident Register copy and other connected materials. It revealed that the injured is still undergoing treatment and has sustained a spinal fracture. In view of the nature of the injuries sustained, this Court is not inclined to grant anticipatory bail to the petitioner. 3/5 https://www.mhc.tn.gov.in/judis CRL OP(MD).
