THE DISTRICT SUPPLY OFFICER, CIVIL SUPPLIES DEPARTMENT, MARKAPURAM, MARKAPURAM DISTRICT.-523316 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of Mandamus, declaring the action of 4th respondent/R.D.O., Markapuram, Markapuram District, who suspended the authorization of petitioner in his proceeding dt.6-3-2026 in Rc.C/241/2025, is illegal, arbitrary and opposed to the spirit of Judgments of this Honble High Court and also against the mandatory provision of Control Orders, and also against Circular, dt.28-9- 2015, and also violate of principals of natural justice and also without opportunity to petitioner and also without jurisdiction and set-aside the proceedings of 4th respondent/R.D.O.,Markapuram, Markapuram District, dt.6-3- 2026 in Rc.C/241/2025 and consequently to direct the respondents to continue the petitioner as FP Shop dealer, Shop No 0811029, Veligandla Village, Konakanametla Mandal, Markapuram Revenue Division, Markapuram District A.P., and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to stay the proceeding of impugned orders of 4th respondent/RDO, Markapuram, dt.6-3-2026 in Rc.C/241/2025, pending disposal of the above Writ Petition and pass Counsel for the Petitioner: 1. GP FOR CIVIL SUPPLIES The Court made the following order: Heard Sri V.M.Chiranjeevi Kolla, learned counsel for the petitioner and Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, for the respondents. 2. Assailing the proceedings issued by the 4th respondent vide Rc.C/241/2025 dated 06.03.2026 (Ex.P1), the above writ petition was filed. Page 3 of 5 3. The petitioner was appointed as the Fair Price Shop Dealer in respect of F.P. Shop No.0811029 of Veligandla Village, Konakanamitla Mandal, Markapuram District. Acting upon the inspection report submitted by the Enforcement Deputy Tahsildar, dated 12.12.2025, a show cause notice vide Rc.E/1038/2025 dated 29.12.2025 (Ex.P2) was issued to the petitioner. The petitioner submitted an explanation dated 30.12.2025 (Ex.P3). Thereafter, by the impugned proceedings Ex.P1, the 4th respondent suspended the authorisation of the petitioner pending inquiry. 4. Learned counsel for the petitioner would submit that, without considering the explanation and without furnishing the relevant documents, the petitioner’s authorisation was suspended. He would further submit that, as per Clause 8(4) of Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, the inquiry must be completed within ninety days. However, the inquiry has not been completed so far. Thus, the learned counsel urged this Court to suspend the proceedings under Ex.P1. 5. Learned Assistant Government Pleader for Civil Supplies, on the other hand, would submit that, considering the variations and the explanation submitted by the petitioner, the authorisation of the petitioner was suspended pending inquiry. He would fairly submit that the inquiry ought to have been completed within ninety days. However, in the case at hand, the inquiry was not completed due to various reasons beyond the control of the authority. Learned Assistant Government Pleader urged this Court to grant four more weeks to complete the inquiry. 6. In reply, learned counsel for the petitioner did not refute the said submission. 7. Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter may not serve any purpose. Accordingly, the writ petition is disposed of, at the stage of admission, with the consent of both the learned counsel, with the following directions: i) The 4th respondent shall furnish a copy of the inspection report and other relevant documents to the petitioner, if not already furnished. ii) The petitioner is at liberty to submit an explanation, if not already submitted. iii) The 4th respondent shall complete the inquiry, keeping in view the time prescribed under Clause-8(4) of the A.P.S.T.P.D.S (Control) Order, 2018. iv) The 4th respondent shall adhere to the circular instructions vide CCS.Ref.No.PDS.II(1)/307/2025 dated 05.12.2025 and the order in W.A.No.122 of 2025. v) The petitioner shall cooperate during the inquiry. vi) If the 4th respondent fails to complete the inquiry within the stipulated time, as referred to supra, the proceedings Ex.P1 dated 06.03.2026 shall stand revoked automatically without any further reference to this Court. vii) In such an event, the 4th respondent shall restore the authorisation of the petitioner in respect of F.P. Shop No.0811029 of Veligandla Village, Konakanamitla Mandal, Markapuram District. viii) There shall be no order as to costs.
