KAMAL ORAL ORDER Petitioner who is accused No.3 in Crime No.301/2013 registered by K.R.Puram Police Station, Bengaluru City, for the offence punishable under Section 379 of IPC, is before this Court seeking Anticipatory Bail. 2. Learned counsel for the petitioner submits that earlier a case in Crime No.186/2012 was registered by Central Crime Branch (H & B) Unit, Bangalore City, for the offence punishable under Sections 457, 380 of IPC in which accused No.3/petitioner herein was arrested and was set free by grant of bail. Later the entire case in Crime No.186/2012 was transferred from CCB Branch, Bangalore City to K.R.Puram Police Station (CCB, H &B) as a connected proceedings in Crime No.301/2013 for the offence punishable under Section 379 of IPC had been registered. - 3 - HC-KAR NC: 2026:KHC:24491 CRL.P No. 2097 of 2026 3. Learned counsel for the petitioner submits that petitioner has not violated the bail terms. That the Police about 2 months ago, after lapse of 13 years have now knocking the doors of the petitioner alleging his involvement in Crime No.301/2013 while he is already on bail in connected Crime No.186/2012. Hence, seeks for bail. 4. Addl. SPP submits that the accused No.3/petitioner ought to have been cautious since he was released on bail. He cannot plead ignorance of registration of a case in Crime No.301/2013 before the K.R.Puram Police Station. As such, he is not entitled for bail as sought for. 5. Heard. Perused the records. 6. Records indicate that accused was earlier arrested in Crime No.186/2012 for the offence punishable under Sections 457, 380 of IPC. He was released on bail. Later the entire case in Crime No.186/2012 has been transferred from CCB Branch, Bangalore City to K.R.Puram Police Station (CCB, H & B), Bangalore City as a connected proceedings in Crime No.301/2013 for the offence punishable under Section 379 of IPC had been registered at the K.R.Puram Police, Bangalore - 4 - HC-KAR NC: 2026:KHC:24491 CRL.P No. 2097 of 2026 City. It is after 13 long years K.R.Puram Police seems to have woken up and proceeding in the matter pertaining to case in Crime No.301/2013. That after filing of charge sheet a criminal case in C.C.No.52406/2013 was filed. The record would speak itself of the snail's pace at which the investigation has proceeded. In the circumstances, this Court is of the considered view that the petitioner has made out a case for grant of bail as sought for. 7. Accordingly, the petition is allowed. The respondent - Police are directed to release the petitioner in the event of his arrest in Crime No. 301/2013 registered by K.R.Puram Police Station, Bengaluru City, for the offence punishable under Section 379 of IPC, subject to the following conditions: (a). Petitioner-Accused No.3 shall execute a personal bond for a sum of Rs.1,00,000/- with two local sureties for the likesum to the satisfaction of the jurisdictional Court; (b). Petitioner-Accused No.3 shall appear before the Investigation Officer within 10 days from the date of receipt of certified copy of this order. - 5 - HC-KAR NC: 2026:KHC:24491 CRL.P No. 2097 of 2026 (c). Petitioner-accused No.3 shall obtain regular bail within 10 days from the date of receipt of certified copy of this order. (d).
