By filing this Criminal Miscellaneous Petition, the petitioner prays for restoration of Acquittal Appeal (D.B.) No. 48 of 2020, which was dismissed for default on account of non-prosecution on 01.08.2024 due to non-removal of defects. Acquittal Appeal (D.B.) No. 48 of 2020 was preferred by the mother of the deceased. 3. Mr. Amit Kr. Das, learned counsel appearing on behalf of the petitioner, submits that the mother of the present petitioner, who has filed Acquittal Appeal (D.B.) No. 48 of 2020, died within two months of filing of the acquittal appeal and the said fact was not within the knowledge of the learned counsel. He submits that the defects thus, could not be removed nor appropriate application could be filed. He further submits that Acquittal Appeal (D.B.) No. 48 of 2020 may be restored. 4. It is submitted that the substitution petition will be filed after restoration of the acquittal appeal. 5. Learned counsel for the State does not oppose the said prayer. 2026:JHHC:5028-DB 6. Considering the aforesaid submission, Acquittal Appeal (D.B.) No. 48 of 2020 is restored to its original file. 7.
