1. Mr. Susheel Kumar, learned counsel holding brief of Mr. Gaurav Singh, learned counsel for the petitioner. 2. Mr. Himanshu Sain, learned A.G.A. for the State. 3. The instant writ petition has been preferred by the petitioner seeking the following reliefs:-
“i) issue a writ, order or direction in the nature of certiorari quashing the impugned FIR lodged by the respondent no.3 on 11.05.2026 registered as FIR No. 196 of 2026 for the alleged offences punishable Under Section 3/11 of the Uttarakhand Protection for Cow Progeny Act, 2007 & Under Section 3/11 of Prevention of Cruelty to Animals Act, 1960, Police Station Bhagwanpur, District Haridwar (contained as annexure no. 1 to the writ petition), so far as it relates to the present Petitioner. From page No.13 to 17. ii) issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.1 and 2 not to take any coercive measure against the petitioner in pursuance to the impugned FIR dated 11.05.2026 registered as FIR No. 196 of 2026 for the alleged offences punishable Under Section 3/11 of the Uttarakhand Protection for Cow Progeny Act, 2007 & Under Section 3/11 of Prevention of Cruelty to Animals Act, 1960, Police Station Bhagwanpur, District Haridwar (contained as annexure no. 1 to the writ petition), so far as it relates to the present Petitioner. iii) issue a suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case. iv) award the cost of the petition to the petitioner.”
4. After arguing at length, learned counsel for the petitioner submits that petitioner is ready to surrender before the court concerned, however, some protection
2026:UHC:3757 may be given to him till he surrenders. 5. The State counsel has no objection. 6. In such view of the matter, instant writ petition is dismissed as withdrawn with liberty to the petitioner to surrender before the court concerned on or before
17.06.2026.
Till then, the petitioner shall not be arrested provided he cooperates with the investigation. ( Rak esh Th apliy al, J.)
