Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioners in connection with Karanjia P.S. Case No.27 of 2026 pending in the file of learned SDJM, Karanjia corresponding to C.T. Case No.60 of 2026 on the grounds stated. 3. Perused the F.I.R. as at Annexure-1. The report is regarding theft of 500 liters of diesel and in that connection, the petitioners apprehend arrest. Recorded the submission of Mr. Parhi, learned counsel for the petitioners and State. On perusal of the F.I.R. as at Annexure-1, the Court finds that diesel was stolen and found in jerrycans and it was recovered and seized by the local police. The names of the petitioners are mentioned p. 2 in the F.I.R., who were found selling the diesel at the relevant point of time. Considering the above facts and submissions of learned counsel for the respective parties, this Court is of the view that the petitioners are not entitled to pre-arrest bail instead should surrender before the learned court below demanding release for its consideration on merit. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioners surrender within a fortnight from today and move applications for regular bail, it shall be considered by the learned SDJM, Karanjia in connection with Karanjia P.S. Case No.27 of 2026 corresponding to C.T. Case No.60 of 2026 during the first hour and in the event of rejection, they shall approach the Sessions Court for orders on the same day during second hours itself and for the said purpose, the relevant record shall be made available. 6.
