ORAL ORDER
Petitioner who is accused No.2 in Crime No.7/2026 registered by the Seshadripuram Police Station, Seshadripuram Sub-division, Bengaluru City for the offences punishable under Sections 314, 318(4), 336(2), 336(3), 338, 335, 62, 340(2) of BNS Act, 2023 is before this Court seeking anticipatory bail.

A complaint dated 23.01.2026 came to the filed by the Branch Manager of HDFC Bank before the respondent- police alleging that accused No.1-Nagaraj and accused No.2- Ajith had come to their Branch seeking to present a blank cheque favouring Sree Saneshwara and Chaudeshwari Trust. The cheque was bearing No.041849 drawn on Account No. 00902790000257 seeking to transfer Rs.12 Crores. Being

suspicious, enquiry was made by the Branch Manager and found that the said cheque was fake. Accordingly, police was summoned and accused No.1-Nagraj was arrested. Upon the arrest of accused No.1- Nagaraj, he has spilled the names of Hemanth @ Harsha- accused No.2, Ajay-accused No.3, Venkatesh-accused No.4. According to prosecution, accused No.1 and these persons had conspired in fabricating the cheque and attempting to transfer the money.

Learned counsel for the petitioner submits that name of the accused is not reflected in the complaint. That apart, accused No.2- Hemanth @ Harsha had already been granted bail by Coordinate Bench of this Court. Hence, seeks for allowing of the petition.
4. Heard. Perused the records.
5. Allegation in the complaint is that accused No.1 along with three others had attempted to present a digitally signed cheque which turned out to be fake. It is only during the interrogation accused No.1 had purportedly taken the name of petitioner herein. It is not the case of prosecution that the said

persons have withdrawn or had the money transferred to any of their accounts. It is only suspicion of they fabricating the cheque and attempting to withdraw the amount. Even according to the prosecution they required to investigate with regard to very alleged mode and manner of fabrication of cheque and the account details to which they had attempted to transfer the amount, which aspects of the matter requires investigation. Further, name of the petitioner is not forthcoming in the FIR, except in the purported statement of accused No.1. No overt act is attributed to any of them including the petitioner herein. The apprehension of the petitioner of his imminent arrest cannot be ruled out.
6. Accordingly, the following;
ORDER i. Petition is allowed. ii. The respondent - Police are directed to release the petitioner in the event of his arrest in Crime No.7/2026 registered by the Seshadripuram Police Station, Seshadripuram Sub-division, Bengaluru City for the offences punishable under Sections 314, 318(4), 336(2),

336(3), 338, 335, 62, 340(2) of BNS Act, 2023, subject to the following conditions: (a). Petitioner-Accused No.2 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two local sureties for the likesum to the satisfaction of the jurisdictional Court; (b). Petitioner-Accused No.2 shall appear before the Investigation Officer within 10 days from the date of receipt of certified copy of this order and cooperate with Investigation Officer. (c). Petitioner-accused No.2 shall obtain regular bail within 10 days from the date of receipt of certified copy of this order. (d). Petitioner-accused No.2 shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon till filing of final report.
