Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:- “a) That the Respondent state may be immediately directed to create proper Promotional avenues for the Petitioners in view of the fact that at present there are no promotional avenues for the category of the Petitioners i.e Computer Operators on the grounds as detailed in the Petition. (b) The state may be directed to suitably upgrade the pay structure / grade pay after two or more years on the grounds as detailed in the Petition at par with the benefits granted to other similarly situated employees in the same pay scale. (c) The Respondents may be directed to suitably amend the R &P rules in the department so that adequate opportunities 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:4658 are created for computer operators to have proper promotions after requisite number of year's upto the Level of Treasury Officers or District Treasury Officers. d) The Respondents may be directed to take a final decision on Annexure P-9 by way of a speaking order in a time bound manner.” 3. The grievance of the petitioners is that they were recruited on contract basis as Computer Operators in the Treasury Department. Subsequently, their services stand regularized, however, in the absence of any promotional avenue being there from the post of Computer Operator, there is stagnation and in this backdrop, they have approached this Court inter alia praying for issuance of a direction to the respondents to create promotional avenues to the petitioners. 4. A perusal of the reply filed by the department demonstrates that there is no denial of the fact that as the cadre of the Computer Operator is a new cadre in the department, there is no promotional post available from the said post but it also stands mentioned in the reply that the matter regarding framing of common promotional rules for Computer Operator is under consideration with the Department of Personnel. 5. Learned Counsel for the petitioner submits that in light 3 2026:HHC:4658 of the stand taken by the respondents in the reply, the petition be disposed of with the direction that let needful be done by the Department of Personnel within three months from today. 6. This Court is of the considered view that as the framing of common promotional rules for Computer Operators is a policy decision which is under consideration with the Department of Personnel, though this Court cannot issue a mandamus to the Authorities to frame any such rule but this petition is disposed of with the observation that as the issue is already under consideration with the Department of Personnel, let a decision in this regard be taken as expeditiously as possible and preferably within the period of 3 to 4 months from today and in case, the Department does take a call to frame common promotional rules for the Computer Operators, then the same be done expeditiously.
