ABLAPL No.1702 of 2026
Sunil Sahu and another …. Petitioners
Mr. B.P. Das, Advocate
-Versus-
State of Odisha …. Opposite Party
Mr. M.K. Mohanty, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 24.03.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Padmapur P.S. Case No.60 of 2025 corresponding to C.T. Case No.37 of 2025 pending in the file of learned Additional Sessions Judge, Gunupur on the grounds stated therein.
3. Recorded the submission of Mr. Das, learned counsel for the petitioners. In fact, the record reveals that the petitioners had earlier approached this Court in ABLAPLs at Flags-A, B & C. Referring to FIR at Annexure-1, Mr. Das, learned counsel submits that the petitioners committed excess and the deceased was said to have been assaulted by them without any individual role attributed to the petitioner and hence, in absence of any such specific allegation against them, both should be allowed to go on bail when some of the accused persons are on bail. It is claimed that the petitioners are similar footing like the co- accused persons, who have been granted bail vide ABLAPL p. 2 Nos.5439, 6836 and 12507 of 2025 disposed of on 13th May, 2025, 20th June, 2025 and 11th November, 2025 respectively. Recorded the objection of the State. It is submitted that the petitioners should be extended parity, but considering the nature of allegations in the FIR at Annexure-1, this Court is not inclined to grant pre-arrest bail to the petitioners, however, is of the view that they should be directed to surrender before the learned court below demanding release on the ground of parity.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioners surrender within a fortnight from today before the learned Additional Sessions Judge, Gunupur in connection with Padmapur P.S. Case No.60 of 2025 corresponding to C.T. Case No.37 of 2025 and move applications seeking release, it shall be entertained and
disposed of considering the plea of parity.
6. Issue urgent certified copy as per rules.
(R.K. Pattanaik) Judge Alok
