This petition has been filed by the State to condone the delay of 132 days in filing the appeal against the Judgment dated 09.10.2025 passed by the Special Court for POCSO Act Cases, Tirunelveli, in Spl.C.C.No.333 of 2019, acquitting the respondent from the charges levelled against him. 2. Mr.V.M.Jegadeesh Pandian, learned counsel, entered appearance for the respondent and seeks time for filing counter. He further submits that it is a case of love affair, however, it has been projected as an offence under POCSO Act. Further, this appeal has been filed by the State at the instance of the defacto complainant. Therefore, the learned counsel opposed for allowing this petition. 3. The State has preferred this criminal appeal with a delay of 132 days. The State is expected to file the appeal after obtaining opinion 1/3 https://www.mhc.tn.gov.in/judis Crl.M.P.(MD)No.12851 of 2026 in Crl.A.(MD)SR.No.34175 of 2026 from the concerned official and the reason for the delay is explained from the Government side. 4. Considering the number of days, this Court is inclined to condone the delay, despite the objection raised by the learned counsel for the respondent/accused. Accordingly, delay is condoned and this petition is allowed. The respondent is at liberty to raise his objection at the time of grant of leave. 5.
