For Petitioner : Mr.J.David Ganesan For Respondents : Mr.R.Parthiban Government Standing Counsel ORDER This Writ Petition has been filed for issuance of a Writ of Certiorarified Mandamus to quash the impugned order in Na.Ka.No. 795/A4/2026 dated 11.02.2026 passed by the third respondent and, consequently, to direct the third respondent to take on file the petition dated 06.02.2026 submitted by the petitioner and complete the enquiry within a time stipulated by this Court. 2. The petitioner claims to be the owner of the lands measuring an extent of 63 cents in Survey No.261/4A, 38 cents out of 66 cents in Survey No.261/4B, 4 cents in Survey No.259/A9, and 90 cents in Survey No.261/A11, which were purchased by the petitioner on 07.02.1996 under registered Document No.162 of 1996. 3. It is the case of the petitioner that a forged document was fraudulently created and registered on 20.08.2001 as Document No.165 of _____________ Page No. 2 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20123 of 2026 2001. Hence, the petitioner has sought to quash the impugned order passed by the third respondent, whereby the petitioner's request for cancellation of the said document was rejected. 4. It appears that there have been further alienations in respect of the properties based on the alleged forged document and that the petitioner's signature was forged and fabricated by the Executant. The appropriate remedy available to the petitioner is to file a suit for declaration before the competent Civil Court and, thereafter, to approach the respondents under Section 83 of the Registration Act, 1908, for initiating prosecution against all the perpetrators of fraud, who had fraudulently executed the documents. 5. Accordingly, the Writ Petition stands disposed of, with liberty to the petitioner to file a suit seeking appropriate declaratory relief before the jurisdictional Civil Court. No costs. Consequently, the connected Miscellaneous Petition is closed.
