This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 115/2024 registered at Police Station Ramanujnagar, District Surajpur (CG) for the offence u/s 302 IIPC. 2. As per the prosecution case, on 30.06.2024, over a dispute of cattle grazing, the applicant threw Budh Ram on the ground and ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.01.21 17:46:47 +0530 2 pressed his neck, as a result of which, deceased died. On the basis of information given by one Sohan Pando, the inquest was registered and postmortem examination was conducted. Upon discovery of incriminating evidence against the applicant during inquest, a case was registered against him u/s 302 of IPC and he was arrested. 3. Since no one appears to argue on behalf of the applicant even in second round, this Court has gone through the grounds mentioned in the bail application, which would go to show that only on suspicion, the applicant has been implicated in this case; the material witness have been examined before the trial Court and they have not supported the case of prosecution; the trial is likely to take time and the applicant is in jail since 30.06.2024, therefore, the applicant may be released on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that there is direct evidence against the applicant and as per the statements of witnesses, the applicant has assaulted the deceased which caused the death. He submits that out of 11 prosecution witnesses, 4 have been examined and the trial is in progress. 5. Having considered the submissions made by learned State counsel and the material available on record, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is rejected. 6. However, looking to the custody period of the applicant and treating it as an exceptional case, the trial Court is directed to expedite the trial as early as possible preferably within a period of 4 months from the date of receipt of copy of this order. 7.
