JUSTICE M.NAGAPRASANNA - 3 - HC-KAR NC: 2026:KHC:23050 CRL.P No. 11850 of 2023 ORAL ORDER The petitioners are before this Court calling in question the proceedings in CC No.1263 of 2023 pending before the Principal Civil Judge and JMFC, Devanahalli, registered for offences punishable under Sections 468, 420, 120B read with Section 34 of IPC. 2. Heard Smt A C Bhavya, learned counsel appearing for the petitioners, Sri B N Jagadeesha, learned Additional SPP appearing for respondent No.1, Sri R D Renukaradhya, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the application seeking permission to compound the offences. Terms of settlement reads as follows: "APPLICATION UNDER SECTION 320 R/W SECTION 482 OF CODE OF CRIMINAL PROCEDURE SEEKING PER MISSION OF THIS HON'BLE COURT TO COMPOUND THE OFFENCES The petitioners humbly submit as follows: - 4 - HC-KAR NC: 2026:KHC:23050 CRL.P No. 11850 of 2023 1. The petitioners have filed the above criminal petition seeking indulgence of this Hon'ble Court to quash the entire proceedings in CC No.1263/2023 on the file of Principal Civil Judge & JMFC., at Devanahalli pending trial for the offences punishable under Sections 468, 420, 120NB r/w Section 34 of IPC. The averments made in the petition may kindly be read as part and parcel of this application to avoid repetition of facts. 2. The petitioners humbly submit that at the intervention of elders and friends, the petitioners and 2nd respondent have arrived at a compromise and in that view of the matter they want to put an end to the above criminal case. 3. The petitioners humbly submit that there is no previous conviction as against them and as such there is no impediment to permit them to compound the offences. 4. The petitioners humbly submit that if the compounding of the offences is not permitted, they would be put to untold hardship. If the same is permitted, no harm or hardship would be caused to the other side. WHEREFORE, it is prayed that this Hon'ble Court may be pleased to permit compounding of the offences punishable under Section 468, 420, 1208 r/w Section 34 of IPC in CC No.1263/2023 on the file of Prl. Civil Judge & JMFC., at Devanahalli to meet the ends of justice." 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the application seeking permission to compound the offences and offences not being against the State, I deem it - 5 - HC-KAR NC: 2026:KHC:23050 CRL.P No. 11850 of 2023 appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in CC No.1263 of 2023 pending before the Principal Civil Judge and JMFC, Devanahalli, against the petitioners stands quashed.
