VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA ORAL JUDGMENT (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The appellant has filed the present appeal impugning an order dated 01.04.2026 passed by the learned Single Judge in Writ Petition No.2304/2026 (CS-RES). The learned Single Judge declined to pass any orders directing respondent No.1 to consider the appellant's representation. Additionally, the learned Single Judge had observed that, in the event the appellant has any grievance against the respondent no. 3 (the Society), it was open for the appellant to raise a dispute in accordance with the provisions of the Karnataka Co-operative Societies Act, 1959. 2. The appellant is a member of the Society. It appears that the appellant is essentially aggrieved by the manner in which the affairs of the Society were conducted. 3. The appellant was elected as one of the directors of the Society pursuant to elections held on 22.09.2024. The appellant made a representation, raising certain grievances - 4 - HC-KAR NC: 2026:KHC:24260-DB WA No. 1233 of 2026 regarding the recruitment of staff and alleging illegal development of layouts. 4. The appellant claims that over a period of time, it had noticed serious irregularities in the functioning of the Society. 5. The appellant claims that pursuant to its representations, an inquiry has been instituted and is continuing. The appellant's grievance is that while the inquiry is continuing, it has made further representations, which have not been taken up. In the aforesaid context, the appellant prays as under: A. Call for records pertaining to proceedings bearing W.P. No. 2304 of 2026 (CS-RES) instituted before this Hon'ble Court; B. Set aside the Order dated 01.04.2026 passed by the Ld. Single Judge in W.P. No. 2304 of 2026 (CS-RES); C. Consequently, allow the Writ Petition filed by the Appellant in proceedings bearing W.P. No. 2304 of 2026 (CS-RES), and issue a writ of Mandamus or any other appropriate writ, order or direction directing Respondent No. 1 to consider and dispose of the Representations dated 27.05.2024 and 08.10.2025, and further directing Respondent No. 2 to consider and dispose of the Representation dated 17.12.2025, within such time frame as may be fixed by this Hon'ble Court (Annexures 'A', 'B' and 'C' respectively). - 5 - HC-KAR NC: 2026:KHC:24260-DB WA No. 1233 of 2026 D. Grant such other reliefs as this Hon'ble Court deems fit in the above circumstances of the case, in the interests of justice and equity. 6. We concur with the view of the learned Single Judge that no mandamus is required to be issued to the inquiry officer to take up matters raised by any member during the pendency of the inquiry. Any inquiry being undertaken would necessarily have to be within the scope of its reference. We find no ground to issue any directions as to the manner in which the inquiry is to be conducted. However, this would not preclude any member from raising any dispute if dissatisfied with the affairs of the Society in accordance with the provisions of the Act. 7.
