The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 3rd and 4th respondents in not preventing the 6th and 7th respondents in making construction of wall in the property belongs to the 5th respondent temple situated in Sy.No.133/2 with an extent of Ac.0-50 cents of Payakaraopeta Village, Visakhapatnam District, is illegal, arbitrary and contrary to the provisions of A.P.Charitable and Hindu Religious Institutions and Endowments Act, 1987 and consequently, direct the respondent Nos.3 and 4 to prevent the respondent Nos.6 and 7 in making construction of compound wall in the property belongs to the 5th respondent temple situated in Sy.No.133/2 with an extent of Ac.0-50 cents of Payakaraopeta Village, Visakhapatnam District and pass such other order or orders.…”
2. Heard learned counsel for the petitioners and learned counsel for the respondents. 3. The Writ Petition filed by the 2nd petitioner is dismissed as abated. 4.
It is the specific case of the 1st petitioner that the ancestors of respondent Nos.6 and 7 have donated the land admeasuring Ac.0.50 cents in Sy.No.133/2 at Payakaraopeta Village, Visakhapatnam District, to the 5th respondent-temple. The property was published under Section 6(c)(ii) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (hereinafter for short the ‘Act’), through proceedings dated
27.09.2022. The 3rd respondent, who is competent authority under the provisions of the Act, registered the subject land under Section 43 of the Act through proceedings dated 23.11.2015. The official respondents are not

protecting the interest of the temple land. The further case of the 1st petitioner is that respondent Nos.6 and 7 are constructing compound wall in the said land, despite the same was gifted to respondent No.5-temple. Hence, the present writ petition is filed to protect the land in Sy.No.133/2A at Payakaraopeta Village, Visakhapatnam District. 5. Respondent Nos.6 and 7 filed counter-affidavit and stated that respondent Nos.6 and 7 are owners and possessors of the land in Sy.No.133/2B and they are not related to Sy.No.133/2A and the unofficial respondents have filed revenue records to establish the same. As seen from the revenue records, unofficial respondents are owners. 6. Therefore, the present Writ Petition is disposed of directing the official respondents to take steps to protect the land in Sy.No.133/2A at Payakaraopeta Village, Visakhapatnam District, by following due process of law. The Writ Petition against the 2nd petitioner is dismissed as abated There shall be no order as to costs.
