KAMAL ORAL ORDER The petitioners/accused Nos.2 to 4 are before this Court seeking for grant of regular bail in Crime No.27/2026 registered by Koratagere Police Station for the offence under Sections 303(2) of the Bharatiya Nyaya Sanhita, 2023. Brief facts of the case: 2. A complaint dated 06.02.2026 came to be filed by the complainant alleging that while he was travelling in a KSRTC Bus on 06.02.2026 at about 12.30 p.m., an unknown person had stolen his OPPO Company mobile phone from his pocket. On realizing the same, the complainant and his friend chased the said person, who got down the bus, ran across the road, got into a car bearing No.KA-02-MQ-7068, fled away. There were 2 to 3 persons in the said car. The value of the mobile was Rs.25,000/-. Accordingly, a case was registered. The charge sheet is stated to have been filed. 3. Learned counsel for the petitioners submits that the complaint was against unknown persons and the Police have - 4 - HC-KAR NC: 2026:KHC:24539 CRL.P No. 3981 of 2026 arrested the petitioners based on suspicion. There is no direct evidence and he seeks for bail. 4. The complaint and FIR was against unknown persons, no identification is provided. There is direct evidence. Considering the allegations made in the complaint and nature of offence and arraying of accused No.2 to 4-petitioners herein, this Court deems it appropriate to grant the bail to the petitioners. 5. Accordingly, following: ORDER (i) Petition is allowed. (ii) Petitioners are directed to be enlarged on bail in Crime No.27/2026 registered by Koratagere Police Station, for the offences punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023, subject to following conditions: a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with one surety each for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless - 5 - HC-KAR NC: 2026:KHC:24539 CRL.P No. 3981 of 2026 the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
